Serta China is accused of tolerating grey-market channel diversion and its staff taking private, off-the-books payments, alongside alleged racial / national-origin discrimination. The fifth notice puts the money question at the centre: a genuine product was paid for in full, yet Serta China can neither name the authorised channel nor produce an official-channel payment record — while a Chinese consumer was also held to a lower service standard than US consumers.

- How discrimination works
Discrimination is not limited to a single insulting sentence. It also appears when one brand places consumers of different race, national origin or region into different treatment systems. Serta markets a complete service system to US consumers: scheduled delivery, setup, clean-up and after-sales accountability. This Chinese consumer received violent handling, no installation standard, no responsible person and silence from headquarters.
- Known risk

- Tolerated diversion
If Serta China can only confirm that the product is genuine but cannot identify the exact purchase-channel source, regional movement path and responsible dealer, the issue is not inadequate consumer proof. It is Serta China's channel-management failure: genuine goods without traceable source show cross-region diversion, store-transfer opacity and disruption of regional sales coordination.
- The money trail
Put three documented facts together: I paid in full (~US$23,000 / about HK$168,180); the product is called genuine, yet Serta China cannot identify the exact authorised purchase-channel source; and I was blocked immediately after paying, with no official invoice and no accountable channel. The most natural explanation is that the money never flowed through Serta's official channel and invoicing at all — that it was collected privately, off the books.
- Private collection is the mechanism
Channel diversion does not run itself; people run it. Staff or channel operators who take payment privately, outside authorised billing, and move goods across regions are precisely how a genuine product ends up with no traceable channel. Private off-book collection and diversion are two halves of the same conduct: one hides the money, the other moves the goods. Serta China is put to proof that this payment went through an official channel with an official invoice, and asked what controls it has against private off-book collection and commercial-bribery-type conduct in its channels.
- Channel failure
The label inconsistencies, QR/barcode traceability evidence, possible store-transfer records, and the silence of Serta China raise a management question: is headquarters tolerating channel diversion, mismatched goods and installation misconduct rather than investigating them?
- Legal lens
Hong Kong law gives this dispute several possible routes: race / national-origin discrimination in the provision of goods and services, false or misleading trade descriptions, breach of sale-of-goods quality / description obligations, and failure to provide services with reasonable care and skill.
